The court does not have a gender preference, and either parent can petition to have custody of children, but you will have to prove that you are an active and involved parent and that you will provide the best environment. When parents cannot agree on primary custody and visitation for children, we work with child custody evaluators and a court-appointed guardian ad litem to aid in that decision. Child Support is determined by state guidelines, and judges have only a limited ability to deviate from them. They can, however, if a clear case can be made for why support should be more or less than the guidelines specify. Modification of Existing Court Orders: Your income may increase or decrease during the years your child support order is in force.
